Along with evidence tampering, a recently discovered record in the government’s discovery evidence proves that someone using the Dread Pirate Roberts (DPR) account logged into the Silk Road forum on Nov. 18, 2013, nearly seven weeks after Oct. 1 when Ross Ulbricht was arrested and put into federal custody (four days before the Silk Road forum was taken offline on November 22, 2013).
There is a record in the Silk Road forum database for every account, showing the most recent log-in. Although we know that DPR logged in on November 18, 2013, we still don’t know:
- when that person or persons originally gained access;
- how many times they logged into Silk Road as DPR since gaining access. or what they did;
- how many DPRs there were and when they operated.
A big part of the government’s argument was that Ross was the one and only person acting as DPR. This is definitive proof that this is not true.
The defense contested at trial that Ulbricht was framed by the “real” Dread Pirate Roberts. They attempted to present evidence to the jury that strongly indicated the existence of other DPRs, but this was not permitted by the judge.
